DETAILED DESCRIPTION OF GOODS AND SERVICES

ED MURRAY RACING CC is a business in the kart racing industry that supplies karts, engines, tyres, spare parts and clothing.

DELIVERY POLICY

Subject to availability and receipt of payment, requests will be processed within two days and delivery confirmed by way of pro-forma invoice number. Unless a delivery option is selected and charged for, collection must be arranged by the customer.

RETURN AND REFUNDS POLICY

The provision of goods and services by ED MURRAY RACING CC is subject to availability. In cases of unavailability, ED MURRAY RACING CC will refund the client in full within 30 days. Cancellation of orders by the client will attract a 10 % administration fee.

Our policy lasts 30 days. If 30 days have gone by since your purchase, unfortunately we can’t offer you a refund or exchange.

To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.

To complete your return, we require a receipt or proof of purchase.

Please do not send your purchase back to the manufacturer.

Refunds (if applicable)
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.
If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within certain amount of days.

Late or missing refunds (if applicable)
If you haven’t received a refund yet, first check your bank account again.
Then contact your credit card company, it may take some time before your refund is officially posted.
Next contact your bank. There is often some processing time before a refund is posted.
If you’ve done all of this and you still have not received your refund yet, please contact us at info@kart.co.za.

Sale items (if applicable)
Only regular priced items may be refunded, unfortunately sale items cannot be refunded.

Exchanges (if applicable)
We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at info@kart.co.za and send your item to: Ed Murray Racing cc, Zwartkops Raceway, R55 Pretoria West Gauteng South Africa 0037.

Gifts
If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.

If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and he will find out about your return.

Shipping
To return your product, you should ship your product to: Ed Murray Racing, Zwartkops Raceway, R55 Pretoria West Gauteng South Africa 0037.

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

Depending on where you live, the time it may take for your exchanged product to reach you, may vary.

If you are shipping an item over ZAR 750, you should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall Ed Murray Racing cc, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Customer privacy policy

ED MURRAY RACING CC shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). Payment options accepted

Payment may be made via Visa and MasterCard or by bank transfer into the ED MURRAY RACING CC bank account, the details of which will be provided on request.

Credit card acquiring and security

Credit card transactions will be acquired for ED MURRAY RACING CC via Yoco (Pty) Ltd who are the approved payment gateway for Standard Bank of South Africa. Yoco uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website. Users may go to www.yoco.co.za to view their security certificate and security policy.

Customer details separate from card details

Customer details will be stored by ED MURRAY RACING CC separately from card details which are entered by the client on Yoco’s secure site. For more detail on Yoco refer to www.yoco.co.za

Merchant Outlet country and transaction currency

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

Responsibility

ED MURRAY RACING CC takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.

Country of domicile

This website is governed by the laws of South Africa and ED MURRAY RACING CC chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, Zwartkops Raceway, R55, Pretoria West, South Africa.

Variation

ED MURRAY RACING CC may, in its sole discretion, change this agreement or any part thereof at any time without notice.
